Mastery Technologies Courseware and Software User License Agreement
This is a legal agreement between you, the user of the software and licensed content provided on and through this web site that is the subject of this license, and Mastery Technologies, Inc. ("Mastery"). The accompanying courses, software programs, data files, and multimedia data files ("SOFTWARE") is licensed by Mastery for your use subject to the terms set forth herein.
Your use of the SOFTWARE is evidence of your agreement to the terms and conditions set forth herein. Upon payment of the licensing fee specified on your sales and licensing documents from Mastery, Mastery’s authorized dealer/distributor, or Mastery’s licensed content supplier, you may use the SOFTWARE on a single-user computer. You may not concurrently operate the SOFTWARE from more than the number of computers, terminals, workstations or users specified by your invoice or other purchase documents. You may not use the SOFTWARE to provide training for a fee or resell this license or any right granted under this license unless you have a separate licensing agreement with Mastery to do so.
The SOFTWARE is a collection of programs, data files, and multimedia assets that are owned by Mastery and its content suppliers and is protected by United States copyright laws and international treaty provisions.
The goods and services provided by Mastery are provided AS IS.
THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL MASTERY OR ANY PARTY WHO IS A PROVIDER OF CONTENT MATERIALS USED IN CONJUNCTION WITH THE SOFTWARE BE LIABLE FOR ANY LOSS OF PROFITS AND/OR CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT OR SPECIAL DAMAGES OF ANY KIND UPON THE BREACH OF ANY OBLIGATION CONTAINED IN OR ARISING OUT OF THIS AGREEMENT, OR THE USE OF THE SOFTWARE.
IN NO EVENT SHALL MASTERY OR ANY PARTY WHO IS A PROVIDER OF CONTENT MATERIALS USED IN CONJUNCTION WITH THIS SOFTWARE BE LIABLE FOR ANY LOSS OF PROFITS AND/OR CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT OR SPECIAL DAMAGES OF ANY KIND DUE TO ANY MODIFICATION, ADDITION OR DELETION MADE TO THE SOFTWARE BY OR DIRECTED BY THE CUSTOMER THROUGH THE USE OF THE MASTERY MODIFY SYSTEM OR ANY OTHER MEANS.
